TineezAI is a SaaS platform for AI-powered content generation. Our services include:

- Analysis: Document analysis and AI vision
- API: API integration for developers
2.2 Terms of Use
- Free registration with email verification required
- Usage subject to compliance with Terms of Use and Terms of Sale
- Ethical content standards and applicable usage rules
- Prohibition of illegal, defamatory or rights-infringing content

- No claim by TineezAI: TineezAI does not claim any copyright on content generated by users
- User responsibility: The user remains solely responsible for the use made of generated content and its compliance with third-party rights
2.4.3 TineezAI Property
- Platform and software: TineezAI holds all intellectual property rights on the platform, its architecture, source code and interfaces
- Trademarks and logos: The name "TineezAI", logo and distinctive elements are protected trademarks (article L711-1 of the CPI)
- Databases: Databases created by TineezAI benefit from sui generis protection (articles L341-1 et seq. of the CPI)
- Algorithms and parameters: Algorithms, configurations and parameters developed by TineezAI are protected under trade secret (Directive 2016/943/EU)
2.4.4 User-Submitted Content
- Ownership guarantee: The user guarantees holding all necessary rights on content submitted to the platform (source images, texts, prompts)
- Respect for third-party rights: The user agrees not to submit content infringing third-party intellectual property rights (counterfeiting, plagiarism)
- Protected content: Use of protected works (photos, illustrations, texts) as source requires authorization from rights holders
- Right to image: For content featuring identifiable persons, the user guarantees having the necessary authorizations under image rights (article 9 of the Civil Code)
2.4.5 License Granted to TineezAI
By using TineezAI, the user grants a limited license allowing:
- Technical processing: Right to process, transform and temporarily store submitted content for service execution
- Public galleries: For voluntarily published content, right of display and promotion on the platform
- Service improvement: Use of anonymized metadata for feature improvement
- Limitations: This license is non-exclusive, revocable (by deleting content), and limited to service purposes
2.4.6 Text and Data Mining Exception (TDM)
In accordance with Article 4 of Directive 2019/790:
- Opt-out respected: TineezAI respects reservations expressed by rights holders regarding text and data mining
- Not used for training: User content is not used for training third-party AI models
- Transparency: In accordance with the AI Act, AI model providers we work with are required to document training data used
2.4.7 Counterfeiting and Sanctions
- Prohibition: Any unauthorized reproduction, representation or use of protected content constitutes counterfeiting (articles L335-2 et seq. of the CPI)
- Civil sanctions: Damages, cessation of infringement, publication of judgment
- Criminal sanctions: Up to 3 years imprisonment and 300,000 EUR fine for counterfeiting (article L335-2 of the CPI)

Dispute Resolution Procedure

Competent Jurisdiction
- Professional users: Exclusive jurisdiction of the Commercial Court of Nimes
- Consumer users: Jurisdiction of the court of the consumer's place of residence or the Court of Nimes, at the plaintiff's choice, in accordance with articles R. 631-3 and R. 631-4 of the Consumer Code
Contract Language
The language of these Terms of Use is French. In case of translation, only the French version is authoritative.
Terms of Sale
IMPORTANT WARNING: Purchased credits are strictly NON-REFUNDABLE under all circumstances, including non-use, order errors or change of mind.
3.1 Purpose
These terms exclusively govern the sale of digital credits allowing access to platform features:
- Text: generation, translation, content enhancement
- Vision - Images: image generation, transformation, product reshoot, background removal/change, 4K upscale, enhancement (credits per selected model)
- Vision - Videos: 5-10 second video generation (credits per selected model)
- Analysis: document analysis and vision
3.2 Order Procedure
Prerequisites:

- Minimum age: 18 or parental authorization

3.3 Order Commitment and Finality
Orders become firm and final upon payment validation. Cancellation, modification or refund are impossible. Credits are exclusive to the platform, not convertible to real currency, non-transferable and non-resellable.

3.5 No-Refund Policy
Credits are strictly non-refundable, including in the event of:
- Non-use
- Order error

- Voluntary account closure
- Terms of Use violations leading to suspension
Legal exceptions: Article L221-28, paragraph 13 of the Consumer Code exempts non-tangible digital content from the 14-day withdrawal right. The immediate usability of credits prevents any withdrawal.
3.6 Credit Validity Period
Credits have unlimited validity provided that: the account remains active and compliance with the Terms of Use is maintained.

The platform uses artificial intelligence systems for text generation, translation and content enhancement. All results come from AI algorithms requiring verification before publication.

4.5 AI Complaint Procedure
Users identifying biases, errors or problematic content can contact [email protégé] with precise details. Analysis takes place within 72 business hours. Model parameter corrections are implemented if necessary. Users receive feedback on actions taken.
